{"id":15327,"date":"2025-07-08T10:30:13","date_gmt":"2025-07-08T16:30:13","guid":{"rendered":"https:\/\/ouf.jhy.mybluehost.me\/?p=15327"},"modified":"2025-07-08T11:53:00","modified_gmt":"2025-07-08T17:53:00","slug":"birkenstock-india-counterfeit-lawsuit-2025","status":"publish","type":"post","link":"https:\/\/footwearmagazine.com\/?p=15327","title":{"rendered":"Birkenstock Unveils Legal Push in India Targeting Fake Sandals"},"content":{"rendered":"<p class=\"my-0\">A surge in counterfeit sandals has prompted <a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a> to take decisive legal action in <a href=\"https:\/\/en.wikipedia.org\/wiki\/India\">India<\/a> aiming to safeguard its brand and loyal customers.<\/p>\n<p class=\"my-0\">Indian court-appointed legal representatives inspected small-scale factories in recent weeks to seize suspected counterfeit <a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a> footwear, after the German brand launched an infringement lawsuit, people familiar with the matter <a class=\"break-word hover:text-super hover:decoration-super underline decoration-from-font underline-offset-1 transition-all duration-300\" href=\"https:\/\/www.reuters.com\/sustainability\/boards-policy-regulation\/birkenstock-cracks-down-fakes-india-court-ordered-factory-visits-held-sources-2025-07-06\/\" target=\"_blank\" rel=\"nofollow noopener\">said<\/a>.<\/p>\n<p class=\"my-0\"><a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a>&#8216;s case is happening as other shoemakers are also making headlines in India. <a href=\"https:\/\/www.crocs.com\/\">Crocs<\/a> this month secured a court nod to pursue a nine-year-old infringement case, while <a href=\"https:\/\/www.prada.com\/ww\/en.html\">Prada<\/a> is facing criticism for showcasing sandals similar to ethnic Indian footwear without initially giving credit to India.<\/p>\n<h3 class=\"mb-xs mt-5 text-base font-[500] first:mt-0 dark:font-[475]\"><strong>The Lawsuit and Factory Inspections<\/strong><\/h3>\n<p class=\"my-0\">Reuters is first to reveal the Indian case details related to <a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a> sandals, which have evolved from a counterculture symbol to a trendy fashion item, and are also popular in India.<\/p>\n<ul class=\"marker:text-textOff list-disc\">\n<li>\n<p class=\"my-0\">In May, <a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a> filed an infringement lawsuit in the Delhi High Court against four footwear traders, four factories, and two unnamed individuals.<\/p>\n<\/li>\n<li>\n<p class=\"my-0\">Its complaint stated an internal investigation found counterfeits were being made in rural areas in and around the tourist hub of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Agra\">Agra<\/a>, and sold locally and exported to other countries.<\/p>\n<\/li>\n<\/ul>\n<p class=\"my-0\">On May 26,&nbsp;<strong>Delhi judge Saurabh Banerjee<\/strong>&nbsp;issued a confidential order that was only made public on the court&#8217;s website last week. It said 10 local lawyers were appointed as commissioners to visit the suspected factories.<\/p>\n<h3 class=\"mb-xs mt-5 text-base font-[500] first:mt-0 dark:font-[475]\"><strong>Court Orders and Seizures<\/strong><\/h3>\n<p class=\"my-0\">The judge said commissioners can &#8220;seize, pack and seal the infringing products&#8221;, and his order included photographs that Birkenstock submitted showing the alleged counterfeit footwear and shoe boxes with the company&#8217;s branding.<\/p>\n<ul class=\"marker:text-textOff list-disc\">\n<li>\n<p class=\"my-0\">The visits have been completed and reports were submitted confidentially to the judge, the three people familiar with the matter explained, asking to remain unidentified.<\/p>\n<\/li>\n<li>\n<p class=\"my-0\">The next hearing in the case is set for October 6.<\/p>\n<\/li>\n<li>\n<p class=\"my-0\">The visits were conducted in Agra, home to the Taj Mahal, and in India&#8217;s capital New Delhi, though further details from the inspection remain confidential.<\/p>\n<\/li>\n<\/ul>\n<p class=\"my-0\"><a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a> did not respond to queries from Reuters and its lawyers from Delhi-based law firm <a href=\"https:\/\/www.indiaip.com\/home\">Lall and Sethi<\/a> declined to comment, citing the pending legal case.<\/p>\n<h3 class=\"mb-xs mt-5 text-base font-[500] first:mt-0 dark:font-[475]\"><strong>Judge&#8217;s Observations<\/strong><\/h3>\n<p class=\"my-0\">In his May order,&nbsp;<strong>Banerjee<\/strong> <a href=\"https:\/\/www.reuters.com\/sustainability\/boards-policy-regulation\/birkenstock-cracks-down-fakes-india-court-ordered-factory-visits-held-sources-2025-07-06\/\">said<\/a> he reviewed photographs and samples of the alleged counterfeit products in court, and they &#8220;seem like a cheap knock off&#8221; of <a href=\"https:\/\/www.birkenstock.com\/gb\">Birkenstock<\/a> products.<\/p>\n<blockquote>\n<p class=\"my-0\">&#8220;<strong>Banerjee<\/strong>: &#8216;There is all likelihood of the public getting deceived &#8230;
